Terms and Conditions for Batende Safari Tours

Welcome to Batende Safari Tours. These Terms and Conditions govern all bookings, tours, transportation, and related services provided by Batende Safari Tours. By making a booking or using our services, you agree to the terms below.

2. Booking and Payment
2.1 All bookings are subject to availability and confirmation by Batende Safari Tours.
2.2 A deposit may be required to secure your booking. Full payment must be completed before the commencement of the tour unless otherwise agreed in writing.
2.3 Payments may be made via bank transfer, card payment, cash, or approved payment platforms like pay pal.
2.4 Prices are quoted in South African Rand (ZAR) unless otherwise stated and may change without prior notice due to fuel costs, exchange rates, park fees, or government regulations.
3. Cancellations and Refunds
3.1 Cancellations must be submitted in writing via email.
3.2 Refunds may be granted according to the following cancellation policy:
- More than 14 days before departure: Full refund minus administration fees.
- 7–14 days before departure: 50% refund.
- Less than 7 days before departure: No refund.
3.3 No refunds will be issued for:
- Late arrivals
- Missed departures
- Unused services
- Voluntary termination of a tour by the client
3.4 Batende Safari Tours reserves the right to cancel or reschedule tours due to weather conditions, safety concerns, insufficient participants, vehicle breakdowns, or events beyond reasonable control. In such cases, clients may receive an alternative tour date or partial/full refund at management discretion.
4. Client Responsibilities
4.1 Clients are responsible for ensuring they possess valid travel documents, visas, passports, vaccination certificates, and insurance where required.
4.2 Clients must comply with all safety instructions given by guides, drivers, and tour staff.
4.3 Batende Safari Tours reserves the right to refuse service or remove any client whose behaviour is disruptive, dangerous, abusive, intoxicated, or unlawful without refund.
4.4 Clients are responsible for informing the company of any medical conditions, allergies, disabilities, or dietary requirements before the tour begins.
5. Travel Insurance
5.1 Comprehensive travel insurance is strongly recommended for all guests.
5.2 Insurance should cover:
- Medical emergencies
- Personal injury
- Theft or loss of belongings
- Tour cancellations
- Emergency evacuation
Batende Safari Tours shall not be liable for costs arising from inadequate insurance coverage.
6. Liability Disclaimer
6.1 Participation in tours, safaris, hiking, transportation, and outdoor activities involves inherent risks.
6.2 Batende Safari Tours, its employees, agents, guides, and partners shall not be held liable for:
- Injury
- Illness
- Death
- Loss or damage to property
- Delays
- Accidents
- Natural disasters
- Theft
- Acts of third parties
except where caused by proven gross negligence under South African law.
6.3 Clients participate in tours and activities at their own risk.
7. Wildlife and Safety
7.1 Guests must follow all wildlife safety instructions provided by guides and park authorities.
7.2 Feeding, provoking, or disturbing animals is strictly prohibited.
7.3 Batende Safari Tours is not responsible for incidents caused by failure to follow safety instructions.
8. Transportation
8.1 While every effort is made to ensure punctuality and comfort, Batende Safari Tours is not liable for delays caused by traffic, weather, road conditions, mechanical failures, or circumstances beyond its control.
8.2 Seat belts must be worn at all times where provided.
9. Photography and Marketing
9.1 Batende Safari Tours may take photographs or videos during tours for promotional and marketing purposes.
9.2 By participating in a tour, clients consent to the use of such media unless they notify the company in writing before the tour commences.
10. Privacy Policy
10.1 Personal information collected during bookings will be used solely for operational, communication, and legal purposes.
10.2 Batende Safari Tours will not sell or unlawfully share client information with third parties.
11. Force Majeure
Batende Safari Tours shall not be liable for failure or delay in performing obligations caused by events beyond reasonable control, including but not limited to:
- Natural disasters
- Pandemics
- Government restrictions
- Civil unrest
- Strikes
- Severe weather
- Border closures
12. Governing Law
These Terms and Conditions shall be governed and interpreted in accordance with the laws of the Republic of South Africa.
